Withdrawal of Plea

If you have plead guilty to a crime in Orange County, and you have questions about it, or something isn’t sitting right with you and you feel you got a raw deal, call Mr. Grupenhagen.   Lucky for you, when it’s over, it’s not really over.

What does that mean?   Once a defendant in a criminal case decides to plead guilty to an offense, if there was some mistake by the court, or some other error, the law allows, under limited circumstances, for that person to request to withdraw the plea of guilty and to allow for the problem to be cured.   The judge will not automatically allow a defendant to withdraw that plea of guilty.   There must be legal grounds to do so.   Mr. Grupenhagen is experienced in evaluating the “plea of guilty” and making a determination of 1) if the plea can be withdrawn we.e., there are legal grounds, and 2) would it help to withdraw the plea.

Some things that give rise to grounds for withdrawing a plea include miscommunication to the Defendant about the consequences, or a misunderstanding as to collateral consequences of the plea, say for licensing, or employment, or immigration.   Perhaps there was some other problem involving your prior attorney, and should be discussed with our office to help you decide what to do.
