Vandalism Charges
Vandalism is defined in Penal Code § 594 as: Any person who maliciously commits any of the following acts with respect to any real or personal property not his or her own, in cases other than those specified by state law:
- Defaces with graffiti or other inscribed material,
- Damages, or
- Destroys any real or personal property of another.
Vandalism is a “wobbler”. It can be filed either as a misdemeanor or a felony.
If the amount of damage is over $400 or more, the crime is a felony and punishable
in the county jail, or imprisonment for up to three years and/or a fine up to
$10,000. If the damage exceeds $10,000, then the maximum fine is $50,000! When
the damage is under $400, then the crime is punishable up to one year in jail
and/or $1,000 fine as a misdemeanor. If convicted, the court can order you to
clean up, repair, or replace the damaged property. If the crime involves tagging
or defacing with graffiti by a minor, his or her parents can be ordered to make
sure that the minor keeps the property free of graffiti for up to a year. The
minor may also be ordered to perform community service or undergo counseling.
