Extradition matters are criminal proceedings that can happen in two ways. The first is when someone gets arrested in California for a criminal matter that occurred in another state. That other state (the wanting state) had a criminal matter pending against someone in California who either failed to appear in that other state or was unaware of such a charge. In either situation a warrant is issued and that person in arrested in California on the out of state warrant, also called a Governor's Warrant. In an extradition case, you have the right to an identification hearing in California. The laws of California protect people arrested in California and the state will not release any person to that state unless it is proved that the person before the court is that person that the other state wants. Often, we can negotiate with the "wanting state" and seek a resolution prior to extradition (we.e. prior to them being sent to the state that wants them). we will help you by arguing and explaining to you the best course of action regarding bail, pending charges, and representation in the state that wants you. we can contact that state and speak to the district attorney and try to work out a resolution to reduce charges and avoid extradition.

The second situation is when a person is arrested in another state for a warrant in California. In that situation, we contact the district attorney assigned to the case in California and seek early disposition if at all possible which could avoid that person from returning to California to answer the charges. We can also seek a bail reduction to allow that client to return to California on his or her own written promise to appear rather then being transported while in custody.
